On 31 May 2011 in the case of Derman v Turkey the Court found the latter in violation of Article 3 for failing to punish three police officers found guilty of torturing the complainant in 1999. By failing to punish the officers during their trial in 2001 the domestic authorities had effectively allowed physical and psychological suffering go unpunished. The man was awarded 42, 000 EUROs in non-pecuniary damages as well as legal expenses.
