Bolivia - OPCAT Situation

Bolivia ratified the OPCAT in 2006 and in December 2013 it adopted a national legislation establishing the Service for the Prevention of Torture, a body attached to the Ministry of Justice, to perform the NPM mandate.

Although the NPM has recently started to be operational, the possibility to designate the Ombuds Institution as NPM is currently being considered. The Ombuds Institution filed a proposal to expand its functions to include the NPM mandate. The proposal was approved by the Chamber of Deputies in August 2016 and is pending review by the Senate.

The SPT visited Bolivia in September 2010 and the government sent a reply to the SPT almost a year later. Both documents are still confidential.

The SPT member Maria Margarida Pressburger is the SPT Focal Point for Bolivia.
